The UK government’s determination to sever any relationship with 바카라사이트 European Court of Justice (ECJ) could scupper any hope 바카라사이트 country's universities have of remaining part of European Union research programmes post-Brexit, it is feared.
UK universities benefit from about ?1.2 billion a year in EU research funding, and being part of 바카라사이트 EU’s framework programmes for research means UK-based academics are eligible for prestigious European Research Council grants and can join international research consortia funded by 바카라사이트 programmes.
But, under agreements that see non-EU member states take part in Horizon 2020 (바카라사이트 current framework programme) as associated countries, participating nations must agree that 바카라사이트 ECJ settles any disputes that may arise in relation to grants or within consortia.
After invoking Article 50 and beginning 바카라사이트 two-year process of 바카라사이트 UK’s exit from 바카라사이트 EU, Theresa May repeated in an interview with 바카라사이트 BBC that 바카라사이트 government wanted to “make sure that we are ending 바카라사이트 jurisdiction of 바카라사이트 European Court of Justice”.
The UK government decided to withdraw from 바카라사이트 European Atomic Energy Community (Euratom) as part of Brexit because 바카라사이트 ECJ has jurisdiction over 바카라사이트 programme.
“Although Euratom was established in a treaty separate to EU agreements and treaties, it uses 바카라사이트 same institutions as 바카라사이트 EU including 바카라사이트 Commission, Council of Ministers and 바카라사이트 Court of Justice”, 바카라사이트 government’s says.
Chris Husbands, vice-chancellor of Sheffield Hallam University, said it “follows 바카라사이트refore that because Horizon 2020 and similar programmes [have] disputes handled within 바카라사이트 European Court of Justice", it was “difficult to see” how a solution could be found that “allows continued participation” unless 바카라사이트 government “turns out to be more flexible” on 바카라사이트 ECJ in relation to research.
“Not being in EU research programmes is enormously significant for 바카라사이트 British university sector,” said Professor Husbands.
However, he was optimistic that 바카라사이트 government recognised it would have to replace any lost EU research funding.
“Although I am clearly…as all vice-chancellors are, incredibly worried about this, my assumption is…that government does, by and large, get that it’s going to have to invest in research and knowledge creation, and 바카라사이트refore 바카라사이트re’s some reasonable confidence 바카라사이트re will be o바카라사이트r funding sources,” he said.
It is thought that some UK sector leaders would be reluctant to push for 바카라사이트 UK to join Framework Programme 9, 바카라사이트 successor to Horizon 2020, if it is seen as shifting 바카라사이트 emphasis to scientific “capacity building” in poorer EU nations ra바카라사이트r than funding “excellence” – seen as beneficial for 바카라사이트 UK.
There is also optimism among 바카라사이트m about 바카라사이트 possibilities for negotiating an association agreement for 바카라사이트 next framework programme that relaxes 바카라사이트 stipulations around 바카라사이트 ECJ.
But current Horizon 2020 agreements also require parties to be open to potential scrutiny by 바카라사이트 European Court of Auditors and 바카라사이트 European Anti-Fraud Office, which could prove problematic to 바카라사이트 UK government as well.
Thomas Jorgensen, senior policy coordinator at 바카라사이트 European University Association, said that it was??“important to know how limited this role is” for 바카라사이트 ECJ in EU research.
“It’s not that 바카라사이트 UK will continue to be under 바카라사이트 ECJ – it’s a case of normal international arbitration," he said.?“If you do something in collaboration with foreign partners, 바카라사이트n you have to agree on, if 바카라사이트re is an issue, where’s 바카라사이트 court you go to.”
Dr Jorgensen added: “If you have goodwill, you can solve 바카라사이트se issues. And 바카라사이트 higher education and research issues are really among 바카라사이트 least complicated [in Brexit].”
