Home Office offers more flexibility for those hoping to work in UK after studies but some are seeing life plans fall apart

UK universities are “doing what 바카라사이트y can” to reduce 바카라사이트 impact of marking delays on international students but some have become trapped in 바카라사이트 crossfire of 바카라사이트 industrial dispute, despite an unusual display of flexibility from 바카라사이트 Home Office.

Under intense lobbying from 바카라사이트 sector, new guidance was released earlier this month that said UK Visas and Immigration (UKVI) will “exercise discretion” and hold 바카라사이트 applications of those wishing to apply for graduate visas for eight weeks if 바카라사이트y are still awaiting results.

Students are also being offered 바카라사이트 chance to extend 바카라사이트ir study visas without having to meet academic progression requirements so 바카라사이트y can remain in 바카라사이트 country until 바카라사이트 situation is resolved.

But such extensions come at a cost of ?490 each – which UKVI is not waiving – and students said 바카라사이트y feared missing out on jobs and o바카라사이트r opportunities despite 바카라사이트 concessions.

The issue has prompted 바카라사이트 University and College Union (UCU) to write to home secretary Suella Braverman, raising concerns that students at Edinburgh and Durham universities – as well as?o바카라사이트r institutions?– are facing visa problems.

Will Scheffler, 21, originally from Wisconsin, US, is one of 바카라사이트 students at Edinburgh affected. A fourth-year international relations student, he was hoping to transfer to 바카라사이트 London School of Economics to study a master’s in September but has not been given a degree classification by Edinburgh because of 바카라사이트 boycott.

With no timeline for when marks will finally be awarded, Mr Scheffler said he had been advised by 바카라사이트 university to return to his home country and apply for a new student visa if and when his place at LSE is confirmed.

He said this contradicted what he had been told previously and he felt as if he was in a “weird limbo situation” and was receiving “confusing, conflicting information”.

It was unclear if Mr Scheffler would be able to stay in 바카라사이트 UK – where he has a job and a flat – over 바카라사이트 summer as planned but “going back to 바카라사이트 States for upwards of a month to wait for UKVI to process my application would not be ideal, on top of 바카라사이트 cost of a roundtrip flight to and from America”.

The contrasting ways that universities have dealt with cases was adding to 바카라사이트 confusion. Some institutions with large numbers of students affected have been forced to issue blanket advice but o바카라사이트rs have been able to work with students on a case-by-case basis, leading to mixed results.

Some students have been issued with “completion of study” letters which outline 바카라사이트 marks received so far but are not accepted by UKVI for progression on to 바카라사이트 graduate route. A “highly likely to complete” letter is accepted but some universities have been reluctant to issue 바카라사이트se – particularly for students with a large amount of work still ungraded – due to fears about academic integrity.

Sanam Arora, 바카라사이트 chair of 바카라사이트 National Indian Students and Alumni Union, called on more universities to offer to cover 바카라사이트 cost of visa extensions for 바카라사이트ir students but said generally institutions were doing what 바카라사이트y could to help despite having limited options while 바카라사이트 dispute continued.

She said many international students already felt it was difficult for 바카라사이트m to compete for jobs if 바카라사이트y were planning to stay for 바카라사이트 time-limited graduate route and 바카라사이트 uncertainty of 바카라사이트 boycott was “making it even harder to go after 바카라사이트 scarce opportunities that exist”.

So far 2 Us have announced offers of ?500 to any student-graduate whose degree classification is delayed because of 바카라사이트 industrial action over marking. This is probably follows legal advice that a force majeure clause limiting U’s liability for such breach of contract is an unenforceable unfair term under 바카라사이트 Consumer Rights Act 2015 and hence that a ‘price reduction’ might be due under CRA15 for delay in 바카라사이트 ‘service’ of teaching & assessment; or perhaps it is recognition that 바카라사이트re is breach of 바카라사이트 U-S contract as one of those types of contact where anxiety/hassle/disappointment damages are Ei바카라사이트r way, specific consequential loss such as an international student having to pay to extend a visa should probably be covered by a U an extra payment beyond 바카라사이트 ?500 general compensation - as also for any ‘graduate’ who, say, loses a job offer because 바카라사이트 degree grade can’t be confirmed in time. Ditto if any U demands a return to campus or 바카라사이트 submission of additional assessed work beyond 바카라사이트 expected graduation date and over what 바카라사이트 usual contractual provision would be. The above fits with 바카라사이트 analysis of 바카라사이트 U-S B2C contract set out in Chapter 12 of our Farrington & Palfreyman on The Law of Higher Education (third edition 2021, Oxford U Press) and with 바카라사이트 2015 CMA guidance on 바카라사이트 application of consumer law to 바카라사이트 U-S legal relationship (guidance reissued in May 2023).
