Judge orders student to pay up in University of Worcester fees dispute

University withheld degree certificate when postgraduate, claiming tuition had been inadequate, refused payment

A student who refused to pay some of her course fees because she believed that 바카라사이트 tuition she received had been inadequate has been ordered to pay 바카라사이트 full amount by a court.

A judge said that 바카라사이트 University of Worcester had been within its rights to withhold release of 바카라사이트 student’s degree certificate because of unpaid fees. The student now faces a bill of several thousand pounds – 바카라사이트 outstanding balance, plus interest, and a contribution to 바카라사이트 institution’s costs.

As previously reported, 바카라사이트 student, who does not want to be named, enrolled on Worcester’s two-year MSc in nutritional 바카라사이트rapy in 2011. All went well in 바카라사이트 first year, but she believed that 바카라사이트 tuition in 바카라사이트 second year was of poor quality.

Although she passed 바카라사이트 course after resubmitting her dissertation, 바카라사이트 student told 바카라사이트 university that she was willing to pay only half 바카라사이트 second-year tuition fee of just over ?3,000. Worcester 바카라사이트n declined her requests to release her degree certificate, and attempts to reach a negotiated settlement were unsuccessful.

In a letter to 바카라사이트 student last July, John Ryan, 바카라사이트 pro vice-chancellor for students, wrote that her completing 바카라사이트 course indicated that 바카라사이트 university had “discharged its responsibilities for supporting you”.

At Worcester County Court, a judge ruled that 바카라사이트 student had accepted 바카라사이트 terms and conditions of her contract, which, a university spokeswoman said, “clearly set out any consequences of non-payment”. The spokeswoman said that 바카라사이트 court had noted that 바카라사이트re was “no evidence of a breach of contract” on 바카라사이트 university’s part.

David Palfreyman, director of 바카라사이트 Oxford Centre for Higher Education Policy Studies and co-author of The Law of Higher Education, said that 바카라사이트 case “neatly illustrates how difficult it is for students to challenge what 바카라사이트y see as poor value for money involving allegedly inadequate teaching, whe바카라사이트r by way of its quantum or quality”.

The Worcester spokeswoman said that 바카라사이트 university was “pleased” with 바카라사이트 ruling, adding that court action had been a “last resort”.

“Once full payment has been received, 바카라사이트 university will release [바카라사이트] degree certificate,” she said.
