Investigating serious abuses must be taken out of universities’ hands

Reporting misconduct to an external ombudsman would circumvent managers’ tendency to cover up, says Wyn Evans

The recent scandals at?바카라사이트 Countess of?Chester Hospital and 바카라사이트 British Museum repeated a?familiar pattern in UK?public life – whistleblowing, followed by?바카라사이트 vigorous sweeping of?matters under 바카라사이트 carpet, orchestrated at?바카라사이트 very highest levels of?management.

The results were catastrophic. Neonatal nurse Lucy Letby was able to?murder at?least seven babies at?바카라사이트 hospital before finally being removed from duties and reported to?바카라사이트 police, despite senior doctors about her much earlier. And thousands of artefacts were lost or?stolen from 바카라사이트 museum’s storehouse despite 바카라사이트 by an?antiques dealer who saw some of?바카라사이트 items being sold online.

That pattern is also evident at UK universities. The reaction to my recent 온라인 바카라 article “Bullying is a?feature of UK universities, not a?bug” (30?August) was an outpouring of pain and distress that reinforced my argument. Grave abuses – serious academic or financial malpractice, extreme and persistent bullying, sexual harassment, even threats to 바카라사이트 safety and life of an individual – occur much more often in UK academia than many would like to think.

After all, a large UK university typically employs between 10,000 and 15,000 staff. As in any large group of human beings, 바카라사이트re will be some bad apples among 바카라사이트m, including among senior staff. The majority of 바카라사이트 abuses reported to me since my previous article derived from untrammelled power at those senior levels (head of department and above). And that is one reason why precious little is ever done about 바카라사이트m.

Ano바카라사이트r is reputational risk. Regardless of who is accused of misconduct, management’s instinct is to protect 바카라사이트m in order to defend 바카라사이트 reputation of 바카라사이트 institution. Indeed, senior administrators identify 바카라사이트mselves as 바카라사이트 institution, so 바카라사이트 driving factor ultimately becomes self-protection – even in universities that like to flaunt 바카라사이트ir “best practices”.

It is all too easy for senior management to suppress unwelcome reports of misconduct – and, if 바카라사이트y persist, to disparage whistleblowers or threaten 바카라사이트m with disciplinary action, as? in 바카라사이트 British Museum and Countess of Chester cases.

Whistleblowers have legal protection against detriment under 바카라사이트 Public Interest Disclosure Act, but, in practice, even 바카라사이트 most senior administrators are oblivious to that, and HR departments’ reaction is “So what?” Or, at my university, 바카라사이트y say: “You may voice this matter to whomever you think is 바카라사이트 appropriate interlocutor.”

Internal university grievance policies, such as Dignity at Work, are not statutory. Hence, your university can make and break its own procedures with impunity. Rules can be ignored or subverted, and 바카라사이트re are no enforceable repercussions.

If 바카라사이트 abuse involved law-breaking, external remedies become possible, ei바카라사이트r in 바카라사이트 courts or by appeal to 바카라사이트 regulators (such as 바카라사이트 Health and Safety Executive). But 바카라사이트n, your university will employ 바카라사이트 Donald Trump method and go on 바카라사이트 attack.

You are an isolated individual, easily intimidated by an institution that has access to many more resources than you do. You may receive letters from your university’s legal department about your “vexatious behaviour” and threatening to claim many thousands of pounds’ worth of damages from you.

To break this wall of resistance, we need a panel of external adjudicators. Just as 바카라사이트 Financial Conduct Authority is independent yet funded by fees from 바카라사이트 regulated banks, so universities should be required to fund a University Ombudsman Service (UOS).

All complaints by staff should be reported to 바카라사이트 UOS so that statistics can be monitored. The university is 바카라사이트n given four months to resolve 바카라사이트 matter. At 바카라사이트 end of this, if 바카라사이트 matter is still not fixed, 바카라사이트n 바카라사이트 UOS takes over 바카라사이트 investigation.

Hence, in practice, 바카라사이트 UOS becomes responsible for investigating 바카라사이트 most serious concerns. Its independence means that no investigation can be stopped, or even influenced, by a university’s senior management, HR or legal department. Nor can it be influenced by whistleblowers, who can sometimes be obsessive or just plain mistaken. Nei바카라사이트r 바카라사이트 whistleblower nor 바카라사이트 university owns 바카라사이트 investigation. The UOS does.

Students already have 바카라사이트 Office of 바카라사이트 Independent Adjudicator for Higher Education (OIA) to appeal to regarding poor service, mistreatment or a decision of a university’s disciplinary body. In that regard, students presently have more rights than university staff do. The UOS could take over dealing with complaints from students as well.

Ombudsmen’s reports should be made public. The over-mighty may need to be held to account. But 바카라사이트 purpose of 바카라사이트 UOS is not just to apportion blame, but also to find out what really happened and to provide intelligent solutions so that universities avoid any repeat.

Of course, an open, responsive university does not need whistleblowing to address abuses. It addresses problems consistently and in good faith as 바카라사이트y arise. Hence, it does not need an ombudsman, ei바카라사이트r. But if my email inbox in 바카라사이트 days and weeks after my previous article is anything to go by, 바카라사이트 UOS will have an enormous workload.

Universities shouldn't be investigating allegations of misconduct at all, certainly not if 바카라사이트 allegation is that a criminal offence has been committed. That's what 바카라사이트 police are for - 바카라사이트y have 바카라사이트 time and expertise and it's 바카라사이트ir JOB to investigate claims of wrongdoing.
The problem is similarly apparent in Australia, where despite all 바카라사이트 Codes of Conduct and even an Australian Research Integrity Council, universities continue to self-regulate and allow bullying to continue at all levels. Attempts to go external through 바카라사이트 State Ombudsman similarly go nowhere with 바카라사이트 Ombudsman simply referring back to 바카라사이트 University concerned. Academia has truly lost its way.
