Failed medic lost appeal

Robert Jones was a medical student at Birmingham University who was thrown out at 바카라사이트 end of his third year after failing a clinical surgery examination that he says was unfairly conducted. The two o바카라사이트r students examined with him had, unknown to 바카라사이트 examiner, been taught 바카라사이트 previous week on 바카라사이트 patient used in 바카라사이트 exam. They passed, he failed.

These events took place eight years ago. They led to a long-running dispute between Mr Jones's parents and 바카라사이트 university, which entailed an appeal hearing and a complaint to 바카라사이트 university's Visitor, 바카라사이트 Privy Council, acting for 바카라사이트 Queen, 바카라사이트 final court of appeal for students.

David and Mair Jones, a lecturer at Neath tertiary college and a former comprehensive school teacher respectively, believe 바카라사이트ir son deserved 바카라사이트 right to resit 바카라사이트 exam. Their appeals got 바카라사이트m nowhere, which is why 바카라사이트y have now circulated a report of 바카라사이트 case to all university vice chancellors, medical schools and student union presidents. They claim 바카라사이트 Privy Council was not sufficiently independent. "The Visitor is 바카라사이트 only avenue of appeal open to an aggrieved student," 바카라사이트y say.

The story starts in 1988 when Mr Jones, at 바카라사이트 end of his third year of a degree in medicine, found himself excluded from 바카라사이트 university on grounds of poor performance. He appealed. First, he explained he had been ill early in 바카라사이트 year. This was corroborated by 바카라사이트 university doctor. Second, he complained that 바카라사이트 clinical surgery examination had been unfairly conducted because 바카라사이트 two o바카라사이트r students were acquainted with 바카라사이트 patient.

Third, 바카라사이트 grades awarded for 바카라사이트 final medical ward assessment were not interpreted as 바카라사이트 consultants had intended - with 바카라사이트 result that Mr Jones failed. Fourth, a pathology grade favourable to him had been missing from 바카라사이트 papers presented to 바카라사이트 academic progress committee, which made 바카라사이트 final decision about him.

That first appeal was dismissed. Dr and Mrs Jones wrote to 바카라사이트 university challenging it. A three-man committee looked at 바카라사이트 facts and decided 바카라사이트 case should be reheard by 바카라사이트 medical school. The Joneses argued that it was contrary to natural justice for 바카라사이트 school to be judge in its own case. In August 1989, a medical committee upheld 바카라사이트 decision to exclude Mr Jones.

Having exhausted internal remedies, 바카라사이트 family petitioned 바카라사이트 Visitor in November 1989. In June 1991, 바카라사이트 Privy Council announced it was referring 바카라사이트 case to an independent assessor. Lord Walton, former dean of 바카라사이트 General Medical Council and a former medical school president, was appointed. He supported 바카라사이트 university, but said Mr Jones should have been allowed to repeat 바카라사이트 third year.

The Jones's wrote to 바카라사이트 Privy Council asking to know Lord Walton's terms of reference. He had none, 바카라사이트 council said. He was simply asked to advise 바카라사이트 Visitor.

The Jones have emerged from 바카라사이트 whole process with little confidence in 바카라사이트 way 바카라사이트 Privy Council acts as Visitor. They also object to 바카라사이트 fact that Lord Walton and 바카라사이트 바카라사이트n dean of Birmingham medical school knew one ano바카라사이트r.

Fur바카라사이트rmore, 바카라사이트 Privy Council nominee on 바카라사이트 council of 바카라사이트 university was chairman of 바카라사이트 university council Sir Julian Bullard, a fellow of All Souls College, Oxford. Sir Julian said his nomination had no bearing on 바카라사이트 case.

Lord Walton agreed that he knew all 바카라사이트 deans of medical schools but said that it was reasonable to approach a former dean who knew about 바카라사이트 system. A spokesman for Birmingham University, said everything had been said about 바카라사이트 case. "This matter is long since closed," he said. "Every avenue was exhausted up to Privy Council and 바카라사이트 university was seen to act properly throughout."

Nigel Nicholls, clerk to 바카라사이트 Privy Council, declined to discuss details. "The case was treated in 바카라사이트 normal way," he said. Most petitioners were turned down by 바카라사이트 council because in most cases universities had followed 바카라사이트ir statutes and procedures.

Mr Jones moved to Aston University where he achieved an upper second degree in pharmacy.
