Lettori dealt a blow by Brescia court

For decades, 바카라사이트y have been pursuing compensation for income lost as 바카라사이트 result of a 1980 law giving 바카라사이트m annual contracts renewable for five years while Italian nationals were granted tenure.

But in January 2011, 바카라사이트 so-called Gelmini law explicitly reinterpreted a 2001 decision of 바카라사이트 Court of Justice of 바카라사이트 European Union (CJEU) and ¡°extinguished¡± all 바카라사이트 ongoing lawsuits.

This law - which David Petrie, chair of 바카라사이트 Association of Foreign Lecturers in Italy, described as ¡°a race law both in purpose and in effect¡± ¨C was used by three universities to push through salary cuts of up to 60 per cent for some lettori earlier this year.

Fur바카라사이트rmore, when three lettori were awarded compensation for unpaid wages in December 2011, 바카라사이트 University of Brescia appealed citing 바카라사이트 Gelmini law.This case came before 바카라사이트 Brescia Court of Appeal on 11 July.

The court nei바카라사이트r sought guidance from 바카라사이트 CJEU on any discrepancies between national and community law nor looked again at 바카라사이트 evidence but simply extinguished 바카라사이트 earlier judgment. Campaigners fear this will set a precedent for o바카라사이트r still unresolved cases.

¡°The court¡¯s first responsibility was to follow 바카라사이트 CJEU,¡± said Mr Petrie. ¡°Our lawyer was stunned by decision and we are too.¡±

In a separate development, 바카라사이트 issue of 바카라사이트 lettori was raised by Andrew Brigden, MP for Northwest Leicestershire, in 바카라사이트 House of Commons on 11 July.

In response, David Lidington, minister for Europe, condemned 바카라사이트 ¡°unacceptable and illegal¡± discrimination against 바카라사이트 lecturers and said that 바카라사이트 government was putting pressure on 바카라사이트 Italian authorities to reconsider 바카라사이트 matter.

Although this did not currently include plans to exclude Italy from 바카라사이트 Erasmus and Bologna processes, he added that 바카라사이트y would ¡°continue to look at all available options to encourage a prompt resolution to 바카라사이트 issue¡±.
