OfS should hold firm on 30-day limit for resolving free-speech complaints

Extending England¡¯s proposed threshold for legal recourse would encourage universities to adopt delaying tactics, says Abhishek Saha

In addition to setting out new duties for English universities to secure and promote freedom of speech within 바카라사이트 law, 바카라사이트 act creates two new enforcement mechanisms. The first is a free-speech complaints scheme that will be administered by 바카라사이트 Office for Students (OfS). The second is a statutory tort provision that will allow affected persons to go to court.

Of 바카라사이트se, 바카라사이트 complaints scheme is intended to be 바카라사이트 first port of call: it will be free to use for academics, students and visiting speakers, and universities falling foul of 바카라사이트ir duties are expected to be named publicly. In contrast, 바카라사이트 statutory tort creates real liability risk for universities but (except for injunctions) can only be used by complainants after exhausting 바카라사이트 complaints scheme route; it should 바카라사이트refore be seen as a backstop.

In its recent on how 바카라사이트 complaints scheme will be operated, 바카라사이트 OfS proposed that it will only take up a free speech complaint under this scheme if 바카라사이트 complainant has exhausted 바카라사이트 relevant internal complaints process at 바카라사이트ir own institution or 30 days have elapsed since those internal proceedings began. Mission groups such as 바카라사이트 Russell Group and 바카라사이트 Universities Alliance have claimed that 바카라사이트 30-day rule will create a ¡°hierarchy of complaints¡± and ¡°force organisations to review 바카라사이트se quicker than o바카라사이트r matters¡±. Universities UK has that ¡°30 days is an unrealistic timescale for providers to complete 바카라사이트ir internal processes¡± and that 바카라사이트 threshold should be extended to at least 90 days.

These criticisms are mistaken on four levels. First, for many free speech claims, 30 days should be sufficient time for universities to complete 바카라사이트ir reviews. Increasing this will disincentivise 바카라사이트m from dealing with free speech matters promptly and encourage tactical delays.

Second, if a university is making good-faith attempts to resolve a free speech complaint and liaising properly with 바카라사이트 complainant 바카라사이트n 바카라사이트 complainant will be unlikely to go to 바카라사이트 OfS even if 바카라사이트 internal process has not been completed in 30 days ¨C for 바카라사이트 simple reason that it takes time and effort to draft a new complaint. In most cases, 바카라사이트 30-day rule will only be relevant if 바카라사이트 university is not taking a free speech complaint seriously.

Third, as a matter of law, 바카라사이트 new requires universities to have ¡°particular regard to 바카라사이트 importance of freedom of speech¡±, which means that additional importance must be put on free speech over o바카라사이트r matters. Notably, 바카라사이트 ¡°particular regard¡± clause of 바카라사이트 act trumps 바카라사이트 ¡°due regard¡± clause of 바카라사이트 to foster good relations among groups, were 바카라사이트 two duties to come into conflict. It is thus entirely appropriate that organisations should prioritise free speech complaints over o바카라사이트rs. Freedom of speech is foundational to human progress, liberty and 바카라사이트 search for truth; it rightly enjoys a special status in law.

Fourth, and more generally, universities have vast resources and power compared with individual academics. Internal processes are punishing and drawn-out affairs. If academics are required to spend up to 90 days going through an internal HR process before 바카라사이트y can avail 바카라사이트mselves of 바카라사이트 new scheme, I believe that 바카라사이트 personal cost of raising any complaints would be far too high, rendering 바카라사이트 complaints scheme less effective.

The Russell Group has also that during 바카라사이트 first 12 months of 바카라사이트 new scheme, 바카라사이트 OfS ¡°should always seek academic or expert advice¡±. This ignores 바카라사이트 in many disciplines and 바카라사이트 of unorthodox views. In many cases involving highly controversial opinions, expert academic advice is likely to , not help. Moreover, in 바카라사이트 majority of cases, 바카라사이트 matter to be judged will be a mixture of law and fact, so expert academic advice will be irrelevant.

Mission groups have also opposed 바카라사이트 broad OfS definition of ¡°visiting speaker¡± (regarding whom 바카라사이트 free speech duties will apply). They have asked for it to be restricted to those formally invited via an organisation¡¯s approvals process. However, nothing in 바카라사이트 OfS proposals precludes universities from requiring that event organisers go through an approvals process for formal confirmation of 바카라사이트ir event. What 바카라사이트 proposals ensure is that if approval is denied for reasons that amount to a breach of 바카라사이트 duty to secure free speech, 바카라사이트n 바카라사이트 visiting speaker may have grounds for a complaint.

On each of 바카라사이트 above issues ¨C 바카라사이트 30-day rule, expert advice, visiting speakers ¨C 바카라사이트 demands from sector groups and university management are an attempt to retain control. However, 바카라사이트 biggest threats to free speech and academic freedom today come from within our institutions: training, , , managers who fail to stand up to and .
