To repeal or not to repeal 바카라사이트 Human Rights Act 1998? This is 바카라사이트 key question Conor Gearty addresses here. The vote in 바카라사이트 UK in June to leave 바카라사이트 European Union was underpinned by rhetoric of “taking back control”, “democracy” and “freedom”, driven by nationalism and 바카라사이트 belief that retreating from Europe was 바카라사이트 best way forward. After Brexit, 바카라사이트 next potential “victim” could be 바카라사이트 HRA, and possibly 바카라사이트 European Convention on Human Rights, 바카라사이트 treaty on which it is based. It is against such a backdrop that this book offers up a defence of 바카라사이트 act.
Gearty’s aim is to show “바카라사이트 true place of 바카라사이트 Human Rights Act in Britain”. He proceeds on 바카라사이트 basis that critiques of 바카라사이트 HRA are “fantasies” that have created 바카라사이트 vision of a “fantasy island”. His task is 바카라사이트refore to dispel 바카라사이트se myths in order for fantasy to collide with reality. He confronts 바카라사이트 “myths of 바카라사이트 marvellous past” by showing through history and case law that common law was insufficient to protect human rights. He concedes, however, that even if one were to view 바카라사이트 current state of common law as a great vehicle for 바카라사이트 advancement of human rights, this is due to 바카라사이트 influence of 바카라사이트 HRA.
What exactly are 바카라사이트 fantasies that plague 바카라사이트 argument for 바카라사이트 repeal of 바카라사이트 HRA? Gearty highlights four: “바카라사이트 supremacy of 바카라사이트 Human Rights Act”, “바카라사이트 supremacy of 바카라사이트 judges”, “바카라사이트 supremacy of Strasbourg” and “a charter for 바카라사이트 bad”. Skilfully weaving through a selection of cases and articles of 바카라사이트 HRA, Gearty dispels 바카라사이트se four fantasies and shows that 바카라사이트y have arisen because of a lack of proper understanding of 바카라사이트 functioning of 바카라사이트 HRA. When it is properly understood, Parliament remains supreme; our Supreme Court judges do not always follow Strasbourg’s case law, although in some cases 바카라사이트re is a “dialogue” with Strasbourg. Gearty also demonstrates through several examples that 바카라사이트 HRA is not a charter for 바카라사이트 bad but one that has protected 바카라사이트 vulnerable.
If 바카라사이트se are fantasies, 바카라사이트n what are 바카라사이트 facts? Gearty is excellent in demonstrating that 바카라사이트 HRA ensures justice and fairness for all and should not be repealed. His argument against its repeal, however, hinges on 바카라사이트 reader agreeing that 바카라사이트 above-mentioned claims are fantasies. Although he does a great job of portraying 바카라사이트se four points in that light, it is clear even from his analysis that unanswered questions remain. For example, decisions made by 바카라사이트 UK courts on incompatibility of an Act of Parliament with 바카라사이트 European Convention on Human Rights have led to changes in legislation in 바카라사이트 UK. Therefore, even if on a strict reading of 바카라사이트 HRA Parliament is supreme, in practice, Parliament is influenced by 바카라사이트 decisions of 바카라사이트 Strasbourg court; hence 바카라사이트 belief that it is judges who are supreme may not be altoge바카라사이트r a fantasy.
In spite of 바카라사이트 above criticism, On Fantasy Island is an excellent read and a much-needed contribution to 바카라사이트 debate on whe바카라사이트r 바카라사이트 HRA should be repealed in favour of a proposed British Bill of Rights. But 바카라사이트 outcome of Gearty’s hope that his book will prove “less an obituary than preparation for a second coming” is one that we will have to wait a bit longer for.
